Chapter 2: What the City Actually Needed

Thomas returned the next morning with a measuring wheel, utility plans, and the same calm manner he had shown the day before.

Daniel met him at the curb.

Evelyn was already there.

She had apparently decided she would not miss the inspection.

Thomas measured from the sidewalk toward the flower bed, checking the painted markings against the city map.

Daniel watched every movement.

“Where is the actual utility corridor?” he asked.

Thomas pointed.

“Closer to the curb than we originally thought.”

Daniel looked toward the hydrangea.

“So you don’t need the whole bed?”

“No.”

Relief came quickly, followed by anger.

The flowers had been damaged even though most of them were outside the city’s access area.

Thomas crouched near the stone edging Daniel had installed around the bed.

“This part is a problem.”

Daniel nodded.

“I can remove it.”

Thomas shook his head.

“We’ll tell you exactly what needs to come out. The city doesn’t need to disturb anything beyond the work area.”

Evelyn stepped closer.

“But the flower bed still violates the association’s landscaping standards.”

Daniel turned toward her.

“Then send me a written notice.”

“I’ve already warned you.”

“You entered my yard and destroyed the plants.”

“I was enforcing the rules.”

Thomas looked up from the utility map.

“Did you have authorization to enter the property?”

Evelyn stiffened.

“I am the HOA president.”

“That wasn’t my question.”

Silence settled over the curb.

Daniel had heard Evelyn invoke her position many times. Until that moment, he had never stopped to ask what the position actually allowed her to do.

Thomas stood.

“The city needs a narrow access area near the curb. Once we’re finished, Mr. Mercer can maintain the rest of his landscaping as permitted by the HOA rules.”

Daniel nodded.

“That’s reasonable.”

Evelyn did not.

She stared at the flower bed as though the city had somehow taken her side by refusing to give her more authority.

Thomas packed away the measuring wheel.

“We’ll do the inspection tomorrow. Until then, leave the markings alone.”

This time, Evelyn said nothing.

Daniel looked at the damaged flowers.

The immediate question had been answered: the city did not need the entire bed.

But another question remained.

If Evelyn had no city authority over the property, what authority had she been relying on when she used that trimmer?

Daniel decided he would find out before the damage was simply forgotten.
